The police force is essential to society. Without them, there would be chaos all over the place. Who would maintain peace and order in the communities, and who would respond to emergencies?
However, the police are only people, and as such, they can make mistakes too. These mistakes can vary in degree, but at times, the police can go too far and their wrongdoings can be considered as abusive. While we citizens try to be as understanding as possible, it is not right to allow these people to do something wrong and get away with it. To be safe against such unlawful practices by the police, people have to be aware of actions against the police and know what they can do to keep it from happening again.
There are many situations which call for actions against the police. This article will give a brief summary of the things that normal citizens can do in these situations:
* False imprisonment is one of these cases. A person is falsely imprisoned when they are deprived of liberty (no matter the duration of time) without lawful justification. This can happen when a person is unlawfully detained, perhaps during a checkpoints and searches. Sometimes the power of arrest may not be vested on the arresting party. There are also cases when the reasons for arrest are not clearly stated.
Furthermore, the police may give wrong reasons for the arrest.
* Another common issue is battery or assault. Battery happens when a direct and intentional application of force is used against a person without proper justification. Assault on the other hand happens when a direct intent to harm another person is made clear.
* Police are also subjected to trespassing. This happens when they enter the land or property of another person without authority. When this is established, police must be certain that they have lawful justification for entering.
* Trespass to goods happens when there is an unlawful, direct interference with the goods of another person. This may be claimed when a police does damage in instances like forcible entry, seizure, and even the mere touching of goods.
* Conversion happens when a deprivation of the possession of goods is made by an officer. This usually arises when the police refuse to return seized goods to the owners.
* Lastly, there is malicious prosecution. Persons may opt for this suit when they feel that they have been maliciously prosecuted.
These are just some of the examples of instances wherein you can call for justice against the wrongdoings of these uniformed law enforcers. If you have experienced any of these or know of somebody who did, find out what can be done about it, and make sure this deed will not go unnoticed. While we cannot single out every police officer, there are those who forget what it is they are supposed to do, and instead use their power for the wrong reasons.
